Customer further acknowledges and agrees to the following: (i) plex has the right to control and direct the means, methods and techniques at which the plex solution is provided, (ii) plex may, from time to time, engage independent contractors, consultants, or subcontractors to assist plex in supplying or operating the plex solution, and (iii) plex may make the plex solution available to third parties.3 1.3 downloading the pms software plex may provide downloadable software or mobile application(s) through or as part of the plex solution for use in connection with managing your personal media (the "pms software"). Pms is provided as a component of the resolution (see more on wearing the plex solution under these tos and for compliance with and the following additional obligations. You may only use the pms utility on a device or equipment that you own or control, as long as you are using the plex solution or another plex service. You hereby expressly state that the pms software may include or allow integration with certain third party executables where additional license requirements may apply. Content available through the plex solution. Owing to the aforementioned permission to use the plex solution, the plex solution allows the customer to view or otherwise receive visits to the original content of plex or third parties. "Content" includes, in addition, text, graphics, photographs, sounds, audio, and visuals such as, but not limited to, news reports, podcasts, movies, and ringtones. The availability of such a file may vary, and not all files are available in all formats. Use of the content is subject to the grant of a license to the plex solution, however, in addition, it does not give rise to a transfer and may be subject to additional license terms established by the applicable third party licensor(s). These tos do not grant you the right to copy (further), distribute, create derivative works from, publicly display or otherwise exploit any content. You are expressly prohibited from engaging in or facilitating the unauthorized sharing or distribution of content.5. 1.5. Updates to the plex solution.
